It might be a little morbid, but I think this was Ken Lay having the last laugh. Kind of like Arthur Anderson winning at the Supreme Court, only this time the government is left holding the bag.

If living well is the best revenge as some say then dying well has to be a close second, eh? Mr. Lay died surrounded by his family and friends at his beautiful mountain resort vacation home without having had to serve one stinkin’ day in jail.

Interesting aside.

Turns out that because the case may still have been appealed, Lay’s death expunges the conviction from his record.

It means that any orders to vacate his wealth are annulled, and his family gets to keep millions of dollars that they likely would have lost had he gone to jail.

I was quoted in today’s San Francisco Chronicle as a member of their “Two Cents” contributor panel that “Ken Lay was not a criminal”. I was the only person quoted that said anything positive about him.
